Terms, Policies & Release Agreement

Introduction

At WITHIN by Tris Thorp, we value integrity, clarity, and respect in every interaction. These terms are designed to protect both you—the participant—and the Company, while creating a safe, professional, and transformational environment for personal growth.

By enrolling in any program, membership, course, or coaching service offered by Tris Thorp | Luminary Ventures (“the Company”), you agree to the following Terms, Policies, and Release. Please read them carefully.

1. Participation and Conduct

You agree to participate fully and respectfully in all sessions, exercises, and community interactions. Disruptive, disrespectful, or harmful behavior may result in removal from the program without refund. We reserve the right to maintain the safety and integrity of all group spaces.

2. Refunds, Payments, and Subscriptions

Refund Policy

  • Online Courses: You may request a refund within 7 days of purchase, provided you have not completed or downloaded substantial content.

  • 1:1 Coaching or Mentorship: All sales are final; no refunds are offered once your first session is scheduled or delivered.

  • Memberships and Subscriptions: Subscriptions renew automatically according to your chosen billing cycle. You may cancel any time before your next renewal date. No partial refunds are issued for unused portions of your membership.

Payment Terms

  • By enrolling, you authorize the Company to charge your designated payment method for the agreed-upon total.

  • If you select a payment plan, you agree to complete all scheduled payments even if you withdraw early.

  • Failure to make payments may result in suspension or termination of access to the program or materials until the balance is paid.

3. Intellectual Property

All course materials, recordings, videos, worksheets, and related content are the intellectual property of the Company and are protected by copyright law.

You may use materials solely for your personal, non-commercial use within the program portal. Unless otherwise stated in your specific program details, downloads are not permitted.

You agree not to reproduce, distribute, share, sell, or teach any program content, methods, or materials in any form, whether paid or unpaid, without prior written consent from the Company.

Program recordings (including live group sessions) may be available for replay during or after the program. In some cases, access may be time-limited; in others, ongoing replay access may be provided. Access periods will be specified in your program materials.

4. Confidentiality

Mutual Confidentiality

We honor and protect the confidentiality of all participants. Information shared in coaching sessions, group programs, or private communications will not be disclosed by the Company, except when used in anonymized teaching examples, testimonials, or as part of recorded group sessions that may later be used for educational purposes.

You agree to maintain the same level of confidentiality toward others in the program. This includes not sharing any personal details, names, or identifying information disclosed by fellow participants.

Recorded Sessions

Group sessions may be recorded and later used as part of future trainings or evergreen programs. By participating, you consent to the inclusion of your image, voice, or comments in these recordings, which may be viewed by future participants.

If you prefer not to be visible or identifiable in recordings, you may choose to keep your camera off and use first name only during group calls.

5. Media and Testimonial Release

By participating in any program, session, or communication with the Company, you grant Tris Thorp | Luminary Ventures permission to use your written, verbal, or digital content (including testimonials, feedback, video or audio participation, and comments) for marketing, educational, or promotional purposes.

This may include, but is not limited to:

  • Social media content

  • Website testimonials

  • Email marketing and promotional materials

  • Educational or training content

You waive any right to compensation or approval and release the Company from any claims related to such use.

You may revoke permission for future use of your content at any time by contacting tris@tristhorp.com, though materials already produced or published prior to revocation will remain authorized.

6. Disclaimer

All programs and services are designed for personal and professional growth. They are not substitutes for medical, psychological, or therapeutic care.

Participation is voluntary and undertaken at your own discretion and risk. The Company makes no guarantees regarding individual outcomes.

You remain solely responsible for your physical, mental, and emotional well-being, decisions, and actions during and after participation.

California residents should note that these programs comply with the state’s coaching guidelines for non-therapeutic personal development services.

7. Limitation of Liability

To the fullest extent permitted by law:

  • The Company’s total liability shall not exceed the total amount paid by you for the specific program or service in question.

  • The Company shall not be liable for indirect, incidental, consequential, or punitive damages arising from your participation.

Participation in any Company program constitutes acceptance of personal responsibility for your results, actions, and well-being.

8. Dispute Resolution and Governing Law

Any disputes or claims arising out of or relating to this Agreement shall be resolved through binding arbitration in San Diego County, California, conducted in accordance with the rules of the American Arbitration Association.

Each party shall bear its own costs and attorney’s fees, and the arbitrator’s decision shall be final and binding.

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

9. Force Majeure

Sometimes life happens. The Company will not be held responsible for delays, interruptions, or cancellations caused by circumstances beyond our reasonable control—including natural disasters, illness, technology failures, or acts of government.

In such cases, we will make every reasonable effort to provide make-up sessions, extensions, or alternate access.

10. Severability and Entire Agreement

If any portion of this Agreement is found unenforceable, all remaining sections shall remain in full effect.

This document constitutes the entire understanding between you and the Company and supersedes all prior agreements, communications, or understandings regarding the subject matter herein.
